I’ve posted before on the issue of background checks for employees; see prior posts here  and here.  Now, the Equal Employment Opportunity Commission (“EEOC”) and the Federal Trade Commission (“FTC”) have issued joint informal guidance concerning background checks and their suggested best practices for such checks.

Employers need to be particularly cognizant of handling background checks with care since the EEOC has targeted enforcement directed to class based recruitment and hiring procedures which includes background checks.
